In a live interview at D8 with Walt Mossberg, Steve Jobs had some juicy things to say about the whole Gizmodo/Brian J Hogan/Jason Chen iPhone 4G/HD prototype scandal. Facing pressure from various media outlets, the DA has unsealed the affidavit for the police raid on Gizmodo’s editor. The court documents reveal that Steve Jobs personally called the blog to “request” the phone back, that Apple instigated the police investigation, that Gizmodo permanently damaged the prototype when it tore the phone to pieces, and that the sellers allegedly knew what they were doing and attempted to hide their identities. “Finders keepers, losers weepers,” right? As it turns out, the finder might be the one crying in the Apple iPhone prototype scandal. 21-year-old Brian J. Hogan has been named as the discoverer of the lost device. His lawyer states that Gizmodo cajoled him into selling the unit, reassuring him “that there was nothing wrong in sharing the phone with the tech press.” Hogan’s story is that he thought he was selling the phone for Gizmodo to review, but Jason Chen instead proceeded to perform disective surgery on the invaluable prototype. Jason Chen, editor of Gizmodo, had a nasty shock on Friday night, when San Mateo police raided his home and seized a bunch of computers, electronics, and other items that might have been “used as the means of committing a felony” in the iPhone 4G/HD prototype purchase. Apple has spoken to the local police about the possibility of criminal charges against the seller of the lost (or stolen) iPhone 4G prototype. A task force for the Santa Clara County district attorney’s office has begun an official investigation into the matter, although it is not known whether Gizmodo is also the subject of the probe. What I find even more entertaining than the iPhone 4G prototype leak is how Gizmodo’s lack of journalistic integrity has impelled the blog to endeavor self justification that is failing, big time. Well, at least Gizmodo’s $5,000 payment for the stolen iPhone prototype captured over 4.2 million visits to the page. I hope that Gizmodo got its money’s worth and enjoyed its fame because Apple has grounds to sue the blog for purchasing stolen merchandise. Writer Jason Chen professes innocence and says that they did not know the prototype had been stolen (yeah right!), yet the law does not require buyers to be aware of a commodity’s legality.
